Terms of service
These terms apply to all services of The Setting Agency, a service of Bolek Jewellery V.O.F., Jan Pietersz. Coenstraat 7, 2595 WP The Hague, Netherlands, KVK 95976159 ("we"), provided to a business client ("you"). A written proposal or order confirmation may add to these terms. Where the two differ, the proposal applies.
1. What we provide
We build lists of businesses in the jewellery trade, write and send outreach emails on your behalf, handle replies and book meetings with interested businesses. We also sell buyer lists for you to use yourself, and run fixed projects with an agreed scope and timeline.
2. Plans and fees
- Pay per meeting: a monthly sending budget plus a fee for each qualified meeting.
- Daily budget: a fee per business contacted, within the daily budget you set, plus a fee for each qualified meeting.
- Buyer lists: a fee per verified contact, with a minimum order.
- Projects: a fixed fee and any success fee as set out in the proposal.
- Branded domains: optional, charged per domain per month.
Current prices are shown on our website or in your proposal. Prices are in US dollars and exclude VAT where applicable.
3. Qualified meetings
A meeting counts as qualified when a decision maker attends, the business matches the criteria agreed with you, and it could realistically buy within six months. Meetings that do not take place because the contact does not attend are not charged. If you believe a meeting was not qualified, tell us within five business days of the meeting and we will not charge it if the criteria were not met.
4. Billing and payment
Sending budgets, daily budgets and monthly fees are invoiced at the start of each month. Meeting fees are invoiced at the end of the month in which the meetings took place. Buyer lists are paid before delivery. Invoices are due within 14 days. We may pause the service while an invoice is overdue.
5. Term and cancellation
Standard plans run month to month. You can cancel by email, effective at the end of the current month. If you agree to a 3, 6 or 12 month commitment in return for a lower rate, the commitment runs for the agreed period. If you end it early, the discount given so far becomes payable. Projects run for the period stated in the proposal.
6. Your approval and responsibilities
We send nothing on your behalf before you have approved the emails. You confirm that the information you give us about your company and offer is accurate, that your products and services are lawful, and that you will tell us straight away if any recipient asks you not to be contacted again.
7. Sending and compliance
We send from our own warmed mailboxes or, if you choose, from new domains set up for you. We never send from your main domain. Every email includes a real postal address and a working opt out, and we follow CAN SPAM, CASL and the GDPR. We may decline to send any message we believe is misleading or unlawful.
8. Lists and data
Contact details of businesses reached during your campaign, together with their replies and meeting notes, are delivered to you and are yours to keep. Buyer lists become yours on payment. For buyer lists, any email address that bounces within 30 days of delivery is replaced free of charge. If you start an outreach plan with us within 30 days of buying a list, the list price is credited against your first month. We process personal data on your behalf in line with our privacy policy and a data processing agreement where required.
9. Exclusivity
We work with one client per product category at a time, and we do not contact the same business on behalf of two clients with competing offers during an active campaign.
10. Results
We do our work carefully and report openly, but we cannot guarantee a particular number of replies, meetings or sales. That is why meeting fees are only charged when meetings take place.
11. Confidentiality
We keep your business information, prices and results confidential and use them only to deliver our services. We may name you as a client only with your permission.
12. Liability
Our total liability under these terms is limited to the fees you paid us in the three months before the event that caused the claim. We are not liable for indirect loss, such as lost profit or lost business, except in case of intent or gross negligence.
13. Governing law
These terms are governed by Dutch law. Disputes are submitted to the competent court in The Hague.
